Letter of Resignation

Mga minamahal kong kababayan:
Mawalang-galang na po sa inyong lahat.
Ano po ba itong nangyayari sa ating mga Pilipino? Tayo po ay nasasakal na halos sa sobrang kahirapan, walang puknat na krimen, walang habas na karahasan, at walang-katapusang katiwalian. Milyun-milyong Pilipino ang walang hanapbuhay. Libu-libo ang nagugutom at ang iba ay nabubuhay na lamang sa kung anong mapulot na tira-tirang pagkain sa basurahan upang malamnan ang kumukulong sikmura. Hindi halos mabilang ang mga kababaihan nating napapariwara sa ibayong dagat at inaabuso, hinahalay, at nilalapastangan araw-araw, makamit lamang ang pinapangarap na magandang bukas para sa mga mahal sa buhay.
Wala na po ni isa sa atin, ang ligtas sa iba’t-ibang uri ng karahasan. Kamakailan lamang ay may isang punong-lungsod ang pinaslang sa sarili nya mismong punong-tanggapan. Isang naninindigang kongresista naman ang binaril sa ulo habang tahimik na kumakain sa isang restoran. Kaya pa ba ninyong bilangin ang mga periodistang pinapatay na parang mga manok dahil lamang sa pagtupad sa kanilang mga tungkulin?
Sa harap ng ganitong mga kasuklam-suklam na pangyayari, nakalulungkot isiping halos lahat sa atin ay nagsisiwalang-kibo na lamang. Tuluyan na bang lumabo ang ating mga paningin? Nagkakalyo na ba ang ating mga puso’t damdamin? Tayo ba ay nagiging henerasyon na ng mga bulag, duwag, mangmang, at mga manhid? Ano bang bagay na may saysay sa ating henerasyon ang maaari nating maipamana o maipagmalaki sa mga susunod pang mga henerasyon? Hahayaan na lang ba nating masumbatan ng saling henerasyon na wala tayong ginawa habang ang ating Inang Bayan ay walang-awang ginagahasa, dinuduraan, niyuyurakan sa harap mismo ng ating mga mata? Tanungin natin ngayon ang ating sarili kung naging makabuluhan ba ang ipinamuhay nating lahat nitong ating kasalukuyang henerasyon!
Ito ang mga dahilan kung bakit kinakailangan na nating bumangon ngayon. Imulat na ang mga mata, tumayo at manindigan. Ayon kay Edmund Burke, isang kilalang intelektwal noong taong 1763, “The only thing necessary for the triumph of evil is for good men to do nothing.” Sa ating sariling wika, ani Burke, “Ang kailangan lamang upang magtagumpay ang mga masasama ay ang pagsasawalang-kibo ng mga mabubuti.”
“The only thing necessary for the triumph of evil is for good men to do nothing.” Let me repeat that! Naniniwala ako na ang pagsasawalang-kibo ay walang maidudulot na kabutihan sa bayan.
Now, let me tell you that there are thousands of good men and women in the Armed Forces of the Philippines and in the Philippine National Police. I know whereof I speak because I am an adopted member of a PMA Class. I like all of my mistahs. They brim with idealism, decency, honesty, and patriotism. As a whole, the good in the AFP/PNP far outnumber the bad.
I call upon you, the officers and staff of the AFP and PNP to be true to your noble goal and mission as the Protector of the People as enshrined in the Constitution of the Philippines. Article 2, Section 3 of the Philippine Constitution is clear and unequivocal ---
“The Armed Forces of the Philippines is the PROTECTOR of the PEOPLE and the STATE. Its GOAL is to SECURE the SOVEREIGNTY of the STATE xxx”
Article 2, Section 1, in turn states ---
“The Philippines is a democratic and republican State. SOVEREIGNTY RESIDES in the PEOPLE and all GOVERNMENT AUTHORITY emanates from THEM.”
The only way for the AFP and the PNP to secure the sovereignty of the State is to secure the very people in whom sovereignty resides. In fact, in international law and international relations parlance, the words sovereignty and people are synonymous and are one and the same. Sovereignty means the people and the people mean sovereignty!
Let me emphasize, the goal of the AFP/PNP is to secure the sovereign people of the Philippines against a clear and present evil. This clear and present evil are the widespread hunger, poverty, and joblessness of 5 million of our people; the underemployment of 7 million; the painful exile of 7 million OFWs most of whom are being sexually brutalized; the breakdown of law and order which have become manifest in the ruthless assassination and murder of both prominent and ordinary citizens; the rampant smuggling of goods into the country which has forced local factories to shut down and to layoff thousands of workers; the unabated illegal logging which caused the deaths of thousands of our countrymen due to landslides and flashfloods; the proliferation of jueteng and other forms of illegal gambling; the unhampered operation of drug syndicates; the fraudulent presidential elections, and many, many more. What could be more pervasive an evil as this litany.
Ladies and gentlemen of the AFP/PNP, it behooves you to protect and secure us, the Sovereign People of the Philippines. Come to our rescue we all implore you! Saklolohan n’yo po kami mga minamahal at ginagalang naming mga Kasundaluhan at mga Kapulisan. Panahon na po upang ipakita ninyo sa buong Sambayanang Pilipino na kayo pong lahat ay mga malilinis at likas na mga mabubuting tao, hindi katulad ni Heneral Carlos Garcia na napabayaan sa kusina ng kanyang mga among, marahil ay mga kawatan din. Ngunit mangilan-ngilan lamang sila kung ihambing sa mga libu-libong matitino at mabubuting sundalo at pulis ng AFP at PNP.
Huwag kayong mag-atubili o mag-aalinlangang isakatuparan ang inyong wagas at sagradong misyon sa Saligang Batas. As a lawyer and former Ambassador and presently as an ILO expert, I have been in frequent consultation with my colleagues in the Philippine Bar Association, the Integrated Bar of the Philippines, and the Diplomatic Corps, and we are one in our analysis that because of the clear and presently oppressive and enormously evil situation that our society and people are now in, you have all the right nay obligation to invoke, assert, execute, and implement Article 2, Section 3 in correlation with Section 1 of the Constitution of the Philippines as Our Protector.
Gagabayan po kayo ng mga sariwang salita ng ating mahal na bayaning si Gat Andres Bonifacio, aniya ---
“Kung ang bayan ay nilalapastangan at niyuyurakan xxx”
“xxx aling kalooban ang di pupukawin sa paghihimagsik?”
“Sa kanyang anyo’y sino ang hindi gugugol ng dugo at buhay?”

Do you know that the United States’ Declaration of Independence recognizes the right of the people to overthrow an abusive government? Ito po ang unanimous declaration ng labing-tatlong Estados ng Amerika noong July 4, 1776 ---
“We hold these truths to be self-evident that all men are created equal, that they are endowed by their Creator with certain inalienable Rights, that among these are Life, Liberty, and the pursuit of Happiness. That to secure these rights, Governments are instituted among men, deriving their just powers from the consent of the governed, --- that whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute a new Government.”
Kasing-liwanag pa sa sikat ng araw na itong kasalukuyang gobyerno natin ay sagad na sa pagka-destructive. My dear countrymen, it is now time to alter and to abolish it, and for us to institute a new government that will break the chains of our hardship and suffering.
Maliban sa mga dakilang salitang binigkas ng Gat Andres Bonifacio, sariwain din natin ang mga salita ng ilan sa mga forefathers ng Estados Unidos.
Ayon kay Samuel Johnson noong taong 1763, “If the abuse be enormous, nature will rise up, and claiming her original rights, overturn a corrupt political system.”
More than twenty years later, Thomas Jefferson, in 1787, concurred when he said: “I hold it, that a little rebellion now and then, is a good thing and therefore, necessary in a political world as storms in the physical… It is a medicine for the sound health of government.”
The following century, Henry Clay, in 1818, expressed the same sentiment, thus: “An oppressed people are authorized whenever they can to rise and break their chains.”
And 30 years after Henry Clay said those words, Henry David Thoreau, in 1849, agreed, thus: “All men recognize the right of revolution; that is the right to refuse allegiance to, and resist the government, when its tyranny, or inefficiency are great and unendurable.”
61 years later, Henry Campbell Black echoed the same sentiment, thus: “The right of revolution is the inherent right of a people to cast out their rulers, change their policy, or effect radical reforms in their system of government or institution, by force or general uprising, when the legal and constitutional methods of making such changes have proved inadequate, or are so obstructed as to be unavailable.”
Si Wendell Philips naman noong 1852 ang nagsabing: “A revolution is as natural a growth as an oak. It comes out of the past, its foundation are laid far back.”
And finally, the pride of the Malayan Race himself, our very own national hero, Dr. Jose P. Rizal said on June 20, 1892, “Nais kong ipakita sa mga nagdaramot ng pagmamahal sa Bayan na alam natin kung paano ang mamatay para sa tungkulin at mga prinsipyo. Anong halaga ng kamatayan kung mamamatay para sa minamahal, para sa lupang tinubuan at mga minamahal na mga mamamayan.” (Jose Rizal, Gregorio Zaide, page 259)
Not all of us can become president of this country. But we can all be patriots like Dr. Jose P. Rizal and Gat Andres Bonifacio, and that is even more exalted. Gary Hart, was right when he said in 1987: “I think there is one higher office than president and I would call that patriot.”
In the face of the prevailing evil that continually strangle and suffocate all of us, what has been the government’s response? Ang tugon nila ay lalong umiigting at lumalawak na pandarambong o Massive Graft and Corruption o MGC o M & G & Company. Ito ang dahilan kung bakit ang bansang Pilipinas ay umaakyat sa ikalawang puwesto sa talaan ng mga “most corrupt countries in the world” at may mga nagsabi pa na inareglo lamang natin ang grupong may gawa ng survey na ito at kung hindi ay siguradong umakyat na tayo sa numero uno na pinaka-corrupt.
Ano ba ang bukam-bibig ng World Bank? Tatlumpung porsiyento daw ng ating taunang budget ay ninanakaw o kini-kickback lamang ng mga taong namamahala sa ating gobyerno. At magkano nga ba ang ating taunang budget? Walumpung-daang bilyong piso (P800-B) po. Samakatuwid, dalawang daan at animnapu’t walong bilyong piso (P268-B) po kada taon ang nakukurakot sa kaban ng kawawang bayan ni Juan. Sa halip na itustos ang malaking halaga na ito para lumikha ng milyun-milyong trabaho para sa mga nagdarahop na Pilipino, ito ay sinisikwat at itinatago ng mga kawatang government officials at ng kanilang mga asawa’t kamag-anak sa mga bangko ng Hong Kong, Bahamas, o di kaya’y Switzerland.
Bibigyan ko kayo ng maliwanag na halimbawa ng isang nakakapanggigil na pangungurakot --- at iyan ay ang Diosdado Macapagal Boulevard d’yan sa may bandang Roxas Boulevard na tinaguriang “world’s most expensive highway.” Limang kilometro lamang ang haba ng kalsadang yan ngunit umabot ng higit sa isang bilyong piso ang ginastos sa pagpapagawa n’yan! Pumapatak na halos dalawangdaang milyon piso bawat kilometro mga kaibigan ang itinustos sa Macapagal Highway (robbery) na iyan. Pwede na nga’ng isali bilang official entry ng Pilipinas sa Guiness Book of World Records!
Dahil sa malawakang nakawan sa gobyerno ay dumadami lalo ang mga nawawalan ng trabaho at nagugutom. Milyon na ang nalagutan ng hininga na hindi man lamang inabot ng gamot o manggagamot dahil sa matinding kahirapan. Ang ating mga ordinaryong kawani ng gobyerno na hindi mabigyan ng disenteng sahod ay gumagapang na rin sa hirap. Ang iba naman ay napipilitang magdelihensya tulad ng ating mga ordinaryong sundalo’t kapulisan para matulungan ang nagigipit na pamilya. Ang ating mga public school teachers at mga midwives, sa liit ng sahod ay nagiging mga katulong sa ibayong dagat na kadalasan ay nagiging biktima rin ng pang-aabusong sekswal ng kanilang mga hayok sa laman ng mga amo, sampu ng ating mga kababaihang probinsyana na walang kamuwang-muwang sa uri ng pamumuhay sa ibang bansa.
My dear compatriots, I appeal to all of you, let’s fight and defeat Massive Graft and Corruption. Labanan natin itong M & G & Company. It is our inherent right to do so. It is as natural a growth as an acacia tree. This is what our forefathers did in 1896 when they fought and expelled the Spaniards; this is what the French and the American people did hundreds of years ago against their oppressors; this is what we, as a proud and self-respecting people will do NOW! --- Patalsikin ang Massive Graft and Corruption!
Sa aking mga kababayan, masaya po ako sa aking paglilingkod bilang pinuno ng NLRC, ngunit ako’y hindi nasisiyahan sa pamunuan ng pamahalaang ito. Ako’y hindi nagbibitiw sa aking paninilbihan sa bayan, ako’y kumakalas lamang sa pamahalaang hindi ko na pinaniniwalaan.
At ngayon, aking lalagdaan ang aking irrevocable resignation.
